PUBLIC NOTICE: TOWN OF RIVERHEAD - ZONING BOARD OF APPEALS

PUBLIC NOTICE

 

Pursuant to Section 267 of the Town Law a Public Hearing will be held by the Zoning Board of Appeals of the Town of Riverhead, Suffolk County, New York on March 9, 2017 at the Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, not before the time shown below on each of the following appeals:

 

7:00 pm, prevailing time, Appeal No. 2017-005,  DC Industries II, LLC, 1146 Main Road, Jamesport, for variances to and/or relief from the provisions of Chapter 301 Section 64 A (3) proposing a change of use to a retail wine shop where the use is not permitted without Main Road (SR 25) frontage between South Jamesport and Washington Avenues.

 

7:00 pm, prevailing time, Appeal No. 2017-009, Anthony Passantino, 47 15th Street, Wading River, for variances to and/or relief from the provisions of Chapter 301 Section 222 E where the proposed additions represent an increase in gross floor area within required side yard setbacks and the roofed-over front entry extends into the required front yard, both representing an increase in the degree of nonconformity of a preexisting nonconforming dwelling where such an increase is not permitted, Chapter 301 Section 222 E where the proposed building area is 22.16% of the lot where the maximum permitted is 20%, Chapter 301 Section 222 E where the front yard setback is 32.3 feet where the minimum required is 50 feet, the proposed side yard setback is 8.33 feet where the minimum required is 20 feet, and the proposed combined side yard is 23.13 feet where the minimum required is 45 feet.

 

7:00 pm, prevailing time, Appeal No. 2017-010, Timothy Murphy, West Main Street, Riverhead, for variances to and/or relief from the provisions of Chapter 301 Section 165 where the proposed building lot coverage is 9.5% of the lot area where the maximum is 8%, the proposed floor area ration is .18 of the lot area where the maximum permitted is .15, the proposed front yard setback is 59.5 feet where the minimum required is 100 feet, the proposed side yard setbacks are 10 feet and 13.3 feet where the minimum required is 30 feet, the proposed combined side yard is 23.3 feet where the minimum required is 60 feet, and the proposed rear yard setback is 95 feet where the minimum required is 100 feet.  

 

7:00 pm, prevailing time, Appeal No. 2017-011, Jonathan Perkins, 804 Sound Shore Road, Riverhead, for variances to and/or relief from the provisions of Chapter 219 Section 14 A(2) where the development is proposed within the restricted bluff area where such development is not permitted, Chapter 301 Section 9 A(1)(a) where the proposed accessory deck is 10.5 feet from the property line where the minimum required is 20 feet, Chapter 301 Section 11 where the proposed impervious surface is 35% of the lot area where the maximum permitted is 15% and Chapter 301 Section 11 where the proposed side yard setbacks are 10.5 feet and 12.5 feet where the minimum required  is 25 feet and the proposed combined side yard is 23 feet where the minimum required is 55 feet.

 

7:00 pm, prevailing time, Appeal No. 2017-012, Frank Gasaparo, 66 Beach Club Lane, Wading River, for variances to and/or relief from the provisions of Chapter 219 Section 14 Subsection A(2) where the trapezoidal middle section of the deck to be legalized is within the restricted bluff area where development in this area is not permitted, Chapter 301 Section 29 Subsection A(1)(b) where the proposed hot tub is 7.4 feet from the property line where the minimum required is 25 feet, the proposed shed is 10 feet from the property line where the minimum required is 20 feet, the trapezoidal middle section of the deck to be legalized is 8.5 feet from the property line where the minimum required is 20 feet, Chapter 301 Section 31 where the proposed impervious surface is 24.2% of the lot area where the maximum permitted is 15%, and Chapter 301 Section 222 Subsection E where the proposed increase in floor area of a preexisting dwelling within the required front, side and rear yard setbacks represents an increase in the degree of nonconformity where such increase is not permitted.

           

Any person desiring to be heard on the above mentioned appeals should appear at the specified time and place.

 

Zoning Board of Appeals work session begins at 6:30 P.M. in the office of the Town of Riverhead Planning Department.
